For addiction and SUD treatment programs

Part 2 protections switched on, not bolted on later.

Assessments, IOP days, group counseling and MAT visits run on one record, while consent and redisclosure rules for substance use records are enforced by the software itself.

  • Consents missing one element

A consent with any required 2.31 element missing simply cannot be saved, and the form names the citation that is incomplete.

  • Records leaving without the notice

Prints and exports of a Part 2 patient carry the 2.32 notice, and are blocked entirely when no active consent covers them.

  • Group days that take a week to chart

One group counseling session produces a separate draft BIRP note for every member who attended.

Part 2

Built against the 2024 final rule, compliance date February 16, 2026.

Flag a patient as Part 2 and the protections follow the record: element-by-element consents, the redisclosure notice on anything shared, and a disclosure log your compliance officer can review.

  • The practice decides whether it is a federally assisted program
  • Per-patient flag rather than all-or-nothing
  • FHIR export blocked without an active consent
  • Counseling process notes stored like psychotherapy notes

Clinical

From the first assessment to medication for addiction treatment.

The SUD assessment covers withdrawal, medical, emotional, readiness, relapse and recovery environment. MAT visits use the medication management template, and buprenorphine is prescribed through DoseSpot EPCS.

Your program decides

Part 2 applies to federally assisted programs that hold themselves out as providing SUD care. THNK Med turns the protections on; whether your program is covered is a call for you and your counsel.

Switching

Coming from another system?

Programs often come from a behavioral-health suite built for residential or IOP care. We confirm consent status for each patient before any record is imported.

Questions

Can a patient revoke a Part 2 consent?

Yes. Every consent records the revocation terms the rule requires, and staff mark it revoked with the date and reason; only active consents cover an export.

Is there a log of what was disclosed and to whom?

Each disclosure made under a consent is written to a disclosure log on the patient, with the consent it relied on.

Do drug screens have their own appointment?

Yes. A drug screen is a 15-minute visit type that only staff can book, so collection days show on the schedule instead of on a clipboard.

Can counselors work with MAT patients without prescribing rights?

Counselors chart the counseling side under their own role. The MAT visit itself is documented by an enrolled prescriber, who sends the prescription through DoseSpot.

Security and the BAA

Protect the records your patients worry about most.

Bring your current consent form to a walkthrough and we will map each element against 42 CFR 2.31.
